Legal advisory services for road projects on motorways A1, A2 and A4: Ongoing support for the contracting authority in contractual relations with motorway concessionaires in the A1, A2, and A4 corridors, including preparing negotiation positions and participating in negotiations regarding changes to concession agreements; legal advice for the implementation of road investments; legal assessment of materials provided by the contracting authority and representatives of other entities designated by the contracting authority, including public administration bodies and external consultants, with particular consideration for limiting risks and threats to the contracting authority; participation in the drafting or evaluation of loan agreements, financial obligation security agreements, and settlement agreements in case of invalidity of direct agreements between the State Treasury, companies, and financing entities; legal advice for conducting contract negotiations and agreeing on the content of documents related to road projects; preparation of written legal opinions related to the implementation of road projects; legal advice for proceedings based on international agreements on the promotion and mutual protection of investments; preparation of draft amendments to agreements for the construction, construction and operation, or solely the operation of motorways; representation of GDDKiA before courts, state and local government administrative bodies, and other offices and institutions, including European and international institutions, in ongoing proceedings, provided this does not conflict with the provisions of the Act on the General Counsel to the Republic of Poland. The number of contracted working hours is 3,000, but not less than 160 hours. The lot is indivisible and must be executed by a single entity to ensure consistent processing of contractual documents and a unified policy towards all private partners.
