Rebate Agreements for Generic Pharmaceuticals: The tender comprises 116 active substance-related lots. For lots 1 to 107, each lot includes eight regional sub-lots, with rebate agreements concluded for each lot-sub-lot combination with one to three pharmaceutical companies. Antibiotic active substances and combinations are tendered in two identical substance lots ("EU-EWR-Lot" and "RM-Lot"). For lots 108 to 116, each lot includes three contract regions, with one rebate agreement per contract region with regional exclusivity. Bids must cover all three contract regions of a lot; awards are generally limited to one contract region per bidder per lot, with exceptions for substitute awards. The contract duration is generally 24 months but ends upon reaching a contractually agreed maximum quantity per combination. Pharmaceutical companies can prevent early termination due to exceeding the maximum quantity by exercising an option right, provided the AOK does not object in time.
