NGA-Breitbandausbau-Schenklengsfeld

Der Beschaffungsgegenstand betrifft die Vergabe einer Dienstleistungskonzession (§ 105 Abs. 1 Nr. 2 GWB, §§ 1 ff. KonzVgV), bei der der Schwerpunkt der Beschaffung auf dem Betrieb eines Gigabit-Breitbandnetzes und dem Angebot breitbandiger Telekommunikationsdienste liegt. Die Dienstleistungskonzession hat den Zweck, die Bereitstellung und den Betrieb eines öffentlichen Kommunikationsnetzes sowie die Bereitstellung von öffentlichen Kommunikationsnetzen im Ausbaugebiet zu ermöglichen. In diesem Zusammenhang wird auf den Ausnahmetatbestand in § 149 Nr. 8 GWB hingewiesen. Der maßgebliche EU-Schwellenwert wird hier unterschritten. Im Einklang mit der ständigen Rechtsprechung (vgl. OLG Dresden, Beschluss vom 21.08.2019 - Verg 5/19; VK Sachsen, Beschluss vom 17.07.2019 - 1/SVK/017-19; VK Mecklenburg-Vorpommern, Beschluss vom 13.12.2018 - 3 VK 9/18) finden danach die Vorschriften des Kartellvergaberechts aus Teil 4 des GWB auf die Bereitstellung einer Investitionsbeihilfe im Rahmen des Wirtschaftlichkeitslückenmodells keine Anwendung. Die Bieter haben daher keinen Anspruch auf Durchführung eines förmlichen Vergabeverfahrens. Der Konzessionsgeber führt jedoch ein öffentliches, transparentes und diskriminierungsfreies Auswahlverfahren unter Beachtung der haushaltsrechtlichen Bestimmungen sowie der Vergabegrundsätze in Anlehnung an ein einstufiges Verhandlungsverfahren nach §§ 12 Abs. 2 KonzVgV, 17 VgV durch. Da es eine entsprechende Verfahrensart auf dem Vergabeportal nicht gibt, wurde hilfsweise als Vergabeart eine offene Ausschreibung gewählt. Es wird aber ein Verhandlungsverfahren durchgeführt.
