Procurement of Lubricants
Lubricants: procurement under a framework purchase agreement, estimated total quantity of 22,569 ME (DB, L) over 12 months. Quantities are based on experience and are for bid evaluation; actual quantities purchased may differ. The contracting authority commits to placing orders for 70% of the total framework amount. Detailed product lists and technical requirements are included in the tender documents. Product types and technical specifications are based on previous orders and may change during negotiations in the second bidding phase. Deviations from specified technical parameters may be allowed after negotiations. In the second bidding phase, bidders must provide the commercial name, manufacturer, manufacturer's part number, or other identifying data (e.g., drawing number, internet manufacturer catalog URL) for the proposed products. For equivalent products, a data sheet or equivalent document (e.g., product description) demonstrating compliance with the technical requirements must be submitted. The quality of equivalent products may be better than specified; proof of equivalence (and better quality, if applicable) is the bidder's responsibility in the second bidding phase. Bidders must declare whether the proposed products are considered hazardous substances or mixtures under applicable legal regulations and submit a Hungarian safety data sheet compliant with Act XXV of 2000 on chemical safety and Commission Regulation (EU) 2020/878. The manufacturer of the proposed products must have a valid ISO 9001 or equivalent quality management system. In the second bidding phase, a simple copy of the certificate from an accredited certification body or documents proving the implementation of the system must be attached; alternatively, an inspection report from an accredited testing institution not older than one year. Negotiations will cover product prices and technical parameters, especially if the specified technical parameters are unclear. The published item list, technical description, and draft contract may be modified as a result of negotiations. Non-negotiable contract terms include: mandatory provisions in any applicable Hungarian or international law, obligations specified in the public service contract between the contracting authority and BKK Zrt. to be fulfilled by the contractor, and the following content in the contract terms: payment deadline, invoice content, confidentiality and data protection provisions, and the temporal validity of the contract. Bidders must declare whether the prohibition on awarding public contracts under Article 5k(1) of Council Regulation (EU) 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine applies to their participation. If the prohibition does not apply, a declaration must be submitted via an EKR form; if the prohibition applies fully or partially, the form provided in the guide must be completed.
