External Legal Services for MHMP – Part 2: Subsidies, State Aid, EU Law

Legal services and legal advice under Act No. 85/1996 Coll., on advocacy: advice in the areas of subsidies, public aid, and EU law, from the perspective of both recipient and provider of subsidies or public aid. The scope includes setting up support regimes and project compliance (opinions on support setup, consultations with managing authorities, rule interpretation, market analyses, assessment of implementation compliance, advice on COCOF guidelines); defense in financial control and levy matters (objections against control protocols, appeals against payment orders, opinions on breach of budgetary discipline, preclusive deadlines for levies); expert analyses/case studies on public aid (especially de minimis, Art. 107 TFEU); legal consultations on subsidy programs; EU compliance outside subsidies/aid (GDPR, eIDAS) including methodologies and recommendations; assessment of notification obligation for technical regulations under EU law; public aid in the area of services of general economic interest, all according to the Framework Agreement (Annex No. 1 of the tender documentation).
