Delivery of standard software with licenses, update rights, and subscriptions: The contract comprises a basic scope and an option right. Basic scope: delivery and activation of subscriptions, with the first subscription period starting on November 1, 2026 (or 3 working days after contract signing if later); the total subscription duration is 36 months. Option right: additional product deliveries in the first and second subscription periods. Equivalent products may be offered; proof of equivalence is the responsibility of the bidder and must meet the criteria specified in the OPZ. Where norms are referenced, equivalent solutions are permissible, with proof of equivalence to be provided by the bidder. For equivalent products, the offer must specify the product type, confirm equivalence according to SWZ criteria, and provide a sample of the equivalent product (temporary licenses/subscriptions) for verification. Equivalence verification involves testing under production conditions within the client's existing system, including Active Directory. A negative test result leads to bid rejection. The bidder must prove Microsoft Licensing Solution Provider (LSP) status in Poland, or for equivalent products, official software distributor status from the manufacturer in Poland. Products and ICT services (including cloud services) must comply with current national cybersecurity law requirements.
