Authority that decides on procurement law violations in review procedures and protects bidder rights.

What is a Procurement Chamber?

The Procurement Chamber (German: Vergabekammer) is an independent authority that reviews procurement law violations in review procedures. It is the first instance for legal protection in EU-wide procurements.

Jurisdiction

  • Federal: Federal procurement chambers at the Federal Cartel Office
  • State: State procurement chambers (usually at district governments)

Review Procedure

  1. Complaint obligation: Bidder must first complain to the authority
  2. Application: Within 15 days of complaint rejection
  3. Review: Chamber examines legality
  4. Decision: Within 5 weeks

  • Annulment of unlawful decisions
  • Order to repeat procedure steps
  • Prohibition of contract award
  • Declaration of legal violation
