What is a Contract Letter?

The contract letter (German: Auftragsschreiben) is the formal document by which a contracting authority places an order with a bidder. It confirms the award and summarizes the essential contract terms.

Contract Formation

The contract is formed through the bidder's offer, acceptance through the contract letter, and receipt by the bidder. If the contract letter deviates from the offer, it counts as rejection combined with a new offer under Section 150(2) BGB.

Bid Validity Period

The contract letter must be received within the bid validity period. Receipt after expiry acts as a new offer from the authority.
